The case revolved around the discovery of dozens of classified files at Trump’s Mar-a-Lago resort in Florida, including some found in a shower and storage room, after he left the White House in 2021.
Judge Cannon’s 93-page order stated, “The Court is convinced that Special Counsel Smith’s prosecution of this action breaches two structural cornerstones of our constitutional scheme—the role of Congress in the appointment of constitutional officers, and the role of Congress in authorizing expenditures by law.”
The former president faced 40 felony counts related to his alleged mishandling of classified documents. Judge Cannon clarified that her decision applies solely to this case and not to a separate one overseen by Mr. Smith concerning alleged efforts to overturn the 2020 election. Trump’s legal team did not file a similar request to dismiss that case.
Recently, Judge Cannon had indefinitely postponed the federal classified documents trial, citing significant questions over the trial evidence. She has previously faced scrutiny over controversial rulings related to Trump’s classified documents case.
This dismissal comes as Republicans gather in Milwaukee, Wisconsin, for the Republican National Convention, where Trump is expected to be officially named the party’s nominee for president later this week. In addition to this case, Trump faces three other criminal prosecutions. In one of these cases, he was found guilty in May of falsifying business records.
Mr. Smith has the option to appeal Monday’s ruling and request a new judge for the case. He has not yet publicly commented on Judge Cannon’s decision.
On Monday, Trump expressed his satisfaction with the dismissal on his social media site, stating, “The dismissal of the case should be just the first step, followed quickly by the dismissal of ALL the Witch Hunts.” He added, “Let us come together to END all Weaponization of our Justice System, and Make America Great Again!”
